Welcome to Swinging Rabbits, a community website for swingers to meet and interact. These Terms of Service (“Terms”) govern your access to and use of the Services provided by Swinging Rabbits, including our website, mobile applications, and any other products or services offered by us (collectively, the “Services”). By using the Services, you agree to be bound by these Terms.

1. Eligibility
   You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
2. User Content
   The Services allow you to submit sexually explicit content, such as photos, videos, messages, and other materials (“User Content”). You retain all rights in, and are solely responsible for, the User Content you submit through the Services.

By submitting User Content, you grant Swinging Rabbits a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in connection with the Services and Swinging Rabbits’ (and its successors’ and affiliates’) business.

However, Swinging Rabbits will not use your User Content for the purpose of marketing, promoting, or redistributing part or all of the Services on any media formats and through any media channels, without your explicit consent. Additionally, we will not post any User Content outside of the website on any other social media platform without your explicit consent.

You represent and warrant that: (i) you either are the sole and exclusive owner of all User Content or you have all rights, licenses, consents, and releases that are necessary to grant to Swinging Rabbits the rights in such User Content, as contemplated under these Terms; and (ii) neither the User Content, nor your submission, uploading, publishing, or otherwise making available of such User Content, nor Swinging Rabbits’ use of the User Content as permitted herein will infringe, misappropriate, or violate a third party’s patent, copyright, trademark, trade secret, moral rights, or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

3. Prohibited Conduct
   You agree not to engage in any of the following prohibited activities:

• Use the Services for any illegal purpose, or in violation of any local, state, national, or international law;
• Submit false or misleading information to Swinging Rabbits, or create a false identity on the Services;
• Impersonate any person or entity, or falsely state or otherwise misrepresent yourself or your affiliation with any person or entity;
• Harass, threaten, or intimidate any other user of the Services, or collect or store personal data about other users;
• Post or transmit any Content that is offensive, obscene, vulgar, or otherwise objectionable;
• Use the Services to distribute or transmit any viruses, malware, or other harmful computer code, files, or programs;
• Engage in any activity that interferes with or disrupts the Services, or any servers or networks connected to the Services;
• Use any data mining, robots, or similar data gathering or extraction methods in connection with the Services;
• Attempt to gain unauthorized access to any portion of the Services or any systems or networks connected to the Services; and
• Encourage or enable any other individual to do any of the foregoing.

Swinging Rabbits reserves the right, in its sole discretion, to investigate and take appropriate legal action against anyone who violates this provision, including removing the offending content from the Services, suspending or terminating the account of such violators, and reporting such violators to law enforcement authorities.

4. Intellectual Property
   The Services and all content and materials contained therein, including without limitation the Swinging Rabbits logo and all designs, text, graphics, pictures, information, data, software, sound files, other files and the selection and arrangement thereof (collectively, “Swinging Rabbits Content”), are the property of Swinging Rabbits or its licensors, and are protected by Singapore and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
   
   You acknowledge and agree that Swinging Rabbits Content may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of Swinging Rabbits or its licensors. Swinging Rabbits reserves all rights not expressly granted in and to the Services and Swinging Rabbits Content.
   
5. Termination
   We may terminate or suspend your access to the Services at any time, with or without cause, and without prior notice or liability. Upon any such termination or suspension, your right to use the Services will immediately cease.
6. Disclaimer of Warranties
   The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including without limitation implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Swinging Rabbits does not warrant that the Services will be uninterrupted or error-free, or that any defects will be corrected. Swinging Rabbits does not warrant or make any representations regarding the use or the results of the use of the Services in terms of its correctness, accuracy, timeliness, reliability, or otherwise. You assume all responsibility and risk for your use of the Services.
7. Limitation of Liability
   In no event will Swinging Rabbits, its affiliates, or their respective licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Services, including any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.
8. Indemnification
   You agree to indemnify, defend, and hold harmless Swinging Rabbits, its affiliates, and their respective licensors, service providers, employees, agents, officers, and directors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Services.
9. Governing Law and Jurisdiction
   These Terms shall be governed by and construed in accordance with the laws of Singapore, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these Terms shall be filed only in the courts located in Singapore, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
10. Modification
    Swinging Rabbits may modify these Terms at any time, and such modifications shall be effective immediately upon posting the modified Terms on the Services. Your continued use of the Services following such posting shall be deemed to constitute your acceptance of such modifications.
11. Entire Agreement
    These Terms constitute the entire agreement between you and Swinging Rabbits with respect to the Services, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Swinging Rabbits with respect to the Services.
12. Waiver and Severability
    The failure of Swinging Rabbits to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms shall remain in full force and effect.
13. Assignment
    You may not assign these Terms or any of your rights or obligations hereunder, whether by operation of law or otherwise, without the prior written consent of Swinging Rabbits. Swinging Rabbits may assign these Terms or any of its rights or obligations hereunder without your prior written consent.
